Terms of Use
These terms are an agreement between you and Don Bytyqi (the "Developer") for the use of Who Called Pest Control (the "Game"). By downloading or playing the Game you accept them. Apple's standard Licensed Application End User License Agreement also applies; where the two differ, these terms take precedence to the extent Apple's agreement allows.
1. Licence
The Developer grants you a personal, non-exclusive, non-transferable licence to install and play the Game on Apple devices you own or control, under your Apple ID, for your own entertainment. You may not copy, modify, decompile, resell, rent or redistribute the Game or any of its art, music, sounds, text or code, or use them to make another product.
2. Free jobs and the full-game unlock
The first jobs are free to play. One non-consumable in-app purchase, the Full Game, unlocks every remaining job, Night Shift, the Full Game weapons and anything else the Game marks as part of the Full Game, permanently, on every device signed in with the same Apple ID. Prices are shown in the App Store before you buy. Purchases are processed by Apple; refunds are handled by Apple under its own terms. Use "Restore Purchases" in the Game to recover the unlock on a new device.
3. Game Center and iCloud
Achievements, leaderboards and cloud saves use Apple's Game Center and iCloud services under Apple's terms. The Developer may remove leaderboard entries that were obtained by modifying the Game or its save data. Leaderboards and achievements may be reset or retired in a future version.
4. Updates and availability
The Developer may update, change or discontinue the Game or any part of it (including jobs, weapons, modes, balance and online features) at any time. Updates may be required to keep playing. The Game is not guaranteed to run on every device or every iOS version.
5. Health notice
The Game contains flashing lights, rapid movement and strobing effects that may affect people with photosensitive epilepsy. A warning is shown on first launch. Stop playing and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, involuntary movement or convulsions.
6. Intellectual property
The Game, including Gus, the pests, the maps, the art, the music, the sounds and the writing, is owned by the Developer and protected by copyright and trademark law. All rights not expressly granted here are reserved.
7. No warranty
The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. The Developer does not promise that the Game will be error-free or uninterrupted, or that saves will never be lost. Back up your device.
8. Limitation of liability
To the fullest extent permitted by law, the Developer is not liable for any indirect, incidental, special or consequential damages, or any loss of data or progress, arising from the use of or inability to use the Game. The Developer's total liability for any claim is limited to the amount you paid for the Game in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
9. Termination
These terms apply for as long as you use the Game. The Developer may end the licence if you break them. Deleting the Game ends the licence; sections 6 to 8 survive.
10. Governing law
These terms are governed by the laws of the Republic of Kosovo, without regard to conflict-of-law rules, and disputes go to the courts there, except where consumer protection law in your country of residence gives you other rights.
11. Changes to these terms
The Developer may change these terms. The date at the top shows the current version; continuing to play after a change means you accept it.
